Maintenance, also known as spousal support or more commonly, alimony, is an issue dealt with in Supreme Court during a matrimonial/divorce action.

  • Parties who are not married, typically do not have standing to seek maintenance, this is an application/issue exclusive to divorce matters.

  • The duration of a marriage, the parties incomes, and other factors greatly contribute to whether a party may be a maintenance candidate and many times, the county in which the parties are seeking maintenance also effects the award. 

  • Maintenance can be obtained on temporary basis while a case is pending and/or permanent as part of the finals terms of an agreement.
